Physicians’ Reciprocal Insurers (PRI) is accredited by the Medical Society of the State of New York to sponsor CMEs for physicians. Physicians who participate in PRI’s risk management programs are awarded CME credits upon successful completion of the program.

  • PRI insureds can access risk management manuals which are periodically updated and revised.

PRI offers 2 different programs:

Basic 5-Hour Program

This course is for those physicians who need to satisfy the New York State Insurance Department Excess 5 hour program, and/or for those physicians who are eligible to receive a 5% discount. After completing the course, each physician will be awarded 8 CME credits.

3-Hour Follow up Program

This course is for those physicians who need to satisfy the New York State Insurance Department Excess 3 hour follow up program, and/or for those physicians who need to renew their 5% discount. After completing the course, each physician will be awarded 5 CME credits.

NY Medical Malpractice: Excess Coverage & Important Changes

As restrictions have been put in place to limit the number of “Excess Slots”/physicians receiving free Excess Coverage, the need for “Paid Excess” has arisen.

Therefore, if a physician does not qualify for Section 18 coverage/free excess coverage the option is available to purchase “Paid Excess.” In addition to your primary limits of liability (1.3/3.9 million dollars) this provides an additional layer of $1 million dollars per claim / $3 million aggregate limit. This takes the standard policy limit from $1.3/3.9 to $2.3/6.9.

Premiums for excess coverage are determined based upon your specialty and the county in which you practice. As long as you carry a policy with an admitted carrier you will be eligible to purchase excess coverage. After completing a brief application we will be able to present you with quotes and help you to bind coverage.

In order to qualify for the FREE/UNPAID NYS Excess Liability Program (Section 18), you must have:

  • a primary affiliation with a New York state general hospital having professional privileges
  • a qualifying individual primary policy of $1.3 million per claim/$3.9 million aggregate
  • completed a qualified risk management program within the last two years

This Excess medical malpractice insurance program is frequently referred to as the NYS Section 18 Program. Consistent with Section 18 Legislation, this is an Occurrence policy provided at no additional cost to physicians, so there is no tail™ required at the conclusion of the policy.

IMPORTANT CHANGES TO EXCESS COVERAGE: NEW THREE YEAR RULE FOR ELIGIBILITY
The State of New York has implemented a three year rule for medical malpractice Excess insurance applicants for the 7.1.2012 – 7.1.2013 policy year. In order to get the free excess coverage, physicians and surgeons would need to have had an Excess policy for all or part of each of the previous 3 years:

7.1.2009 – 7.1.2010
7.1.2010 – 7.1.2011
7.1.2011 – 7.1.2012

If you satisfy the new rules concerning past coverage and are eligible for the Excess coverage as outlined above, you should receive your coverage. If you do not, you are not guaranteed an Excess policy for 2012-13. Applications for those physicians who do not meet the above criteria will be held pending a decision by NY State later this year.

New York Section 18 First Layer Excess Professional Liability Coverage

What is the Section 18 Program?

The Excess Medical Malpractice Insurance Program was established by the NY State Insurance Department, and later extended under Section 18 of the Medical Malpractice Reform Act. First layer excess is an additional layer of insurance protection ($1/3 Million) above the standard primary limits of $1.3/3.9 Million. First layer excess coverage is offered at no additional cost to eligible physicians and dentists who meet the following requirements:

  1. You must maintain primary individual limits of $1.3/3.9 Million with a NY State approved carrier
  2. You must complete a qualified risk management course. The RM course also makes you eligible for an additional 5% discount on your primary individual policy.
  3. You must have active privileges at one or more hospitals in NY State.

The application process is simple: Once you have your primary individual coverage ($1.3/3.9M Limits) through a NY State approved carrier, you can submit the excess application to your primary affiliated hospital along with a copy of your primary coverage and a copy of the Risk Management course certificate.

This valuable coverage is provided at no additional cost to you. If for any reason you do not qualify for the free excess coverage, you may be able to purchase and pay for this coverage through an insurance carrier.
